KillPorts MenuBar Application

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Mediazone.nl, operating under the brand KillPorts.com ("Company", "we", "us", or "our"), governing your access to and use of the KillPorts MenuBar application, website, and related services (collectively, the "Service").
1. ACCEPTANCE OF TERMS
By downloading, installing, accessing, or using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must immediately cease all use of the Service and uninstall any installed components.
We reserve the right to modify these Terms at any time. Continued use of the Service after any such modifications constitutes your acceptance of the revised Terms.
2. DESCRIPTION OF SERVICE
KillPorts is a professional macOS system utility application designed for developers and system administrators. The Service provides the following functionality:
- Real-time monitoring and identification of processes utilizing network ports
- Controlled termination of processes and network connections
- Advanced system administration and port management capabilities
- MenuBar integration for quick access to port management tools
- Elevated privilege operations for system-level process control
3. LICENSE GRANT
Subject to your compliance with these Terms, the Company grants you a limited, non-exclusive, non-transferable, revocable license to:
- Download and install the Service on devices you own or control
- Use the Service for personal or professional purposes
- Make backup copies of the Service for archival purposes
This license does not include the right to sublicense, sell, resell, or commercially exploit the Service without prior written consent from the Company.
4. USER ELIGIBILITY AND RESPONSIBILITIES
4.1 Age and Capacity
You must be at least 18 years of age and possess the legal capacity to enter into binding agreements. Users between 13-18 years of age may use the Service only with verified parental or guardian consent and supervision.
4.2 Technical Competence
By using this Service, you represent and warrant that you:
- Possess adequate technical knowledge to understand the implications of process and port management
- Have experience with macOS system administration concepts
- Understand the potential consequences of forcibly terminating system processes
- Will exercise appropriate judgment and caution when using the Service
- Accept full responsibility for any actions taken using the Service
4.3 Prohibited Uses
You agree not to use the Service to:
- Interfere with or disrupt systems you do not own or have authorization to manage
- Circumvent security measures or access controls
- Engage in any activity that violates applicable laws or regulations
- Cause intentional harm to computer systems or networks

The Service performs system-level operations that can have significant consequences:
- Immediate and irreversible termination of running applications and services
- Permanent loss of unsaved data, documents, and work in progress
- System instability, crashes, or unexpected behavior
- Disruption of network services and connections
- Potential corruption of files or databases with open write operations
- Termination of critical system processes affecting overall system stability
BY USING THIS SERVICE, YOU EXPRESSLY ACKNOWLEDGE AND ASSUME ALL RISKS associated with process termination and port management. You agree that you have been adequately warned of these risks and proceed at your own discretion.
5. INTELLECTUAL PROPERTY
The Service, including its original content, features, functionality, design, and branding, is owned by Mediazone.nl and protected by international copyright, trademark, and other intellectual property laws. The KillPorts name, logo, and all related marks are trademarks of Mediazone.nl.
6. DISCLAIMER OF WARRANTIES
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND.
To the fullest extent permitted by applicable law, the Company expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including but not limited to:
- Implied warranties of merchantability and fitness for a particular purpose
- Warranties of non-infringement or title
- Warranties regarding the accuracy, reliability, or completeness of the Service
- Warranties that the Service will be uninterrupted, secure, or error-free
- Warranties regarding compatibility with your specific system configuration
7. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
In no event shall the Company, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including without limitation:
- Loss of data, corruption, or costs of data recovery
- System downtime, crashes, or business interruption
- Lost profits, revenue, savings, or business opportunities
- Loss of goodwill or reputation
- Cost of substitute goods or services
- Any other intangible losses arising from your use or inability to use the Service
The Company's total cumulative liability shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim, or €50 (fifty euros), whichever is greater.
8. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service or violation of these Terms.
9. GOVERNING LAW AND JURISDICTION
These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of the Netherlands.
10. SEVERABILITY
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
11. ENTIRE AGREEMENT
These Terms, together with our Privacy Policy and any additional terms you agree to, constitute the entire agreement between you and the Company regarding the Service and supersede all prior agreements and understandings.
