End User License Agreement (EULA)
IMPORTANT: PLEASE READ THIS AGREEMENT CAREFULLY BEFORE INSTALLING OR USING THIS SOFTWARE
This End User License Agreement ("Agreement") is a legal agreement between you ("User") and Mediazone.nl / KillPorts.com ("Licensor") for the use of KillPorts software ("Software").
⚠️ CRITICAL SYSTEM UTILITY WARNING
This Software is a powerful system utility that performs privileged operations:
- Forcibly terminates running processes using system-level commands
- Can cause immediate and permanent data loss in applications with unsaved work
- May cause application crashes, system instability, or unexpected behavior
- Can interfere with or terminate critical system processes
- Requires and operates with elevated system permissions
- Actions taken are immediate and cannot be undone
YOU ACKNOWLEDGE THAT YOU USE THIS SOFTWARE ENTIRELY AT YOUR OWN RISK AND ACCEPT FULL RESPONSIBILITY FOR ANY CONSEQUENCES.
1. License Grant
Subject to the terms of this Agreement, Licensor grants you a non-exclusive, non-transferable, limited license to install and use the Software on devices you own or control, for personal or commercial purposes.
2. User Responsibilities and Acknowledgments
By installing and using this Software, you acknowledge, represent, and agree that:
- You are solely and fully responsible for any and all consequences resulting from your use of this Software
- You possess adequate technical knowledge and experience to understand the implications of process termination
- You understand that terminating processes can result in data loss, corruption, or system instability
- You will exercise appropriate caution and judgment when using the Software
- You will not use this Software on production systems without maintaining current backups
- You will verify and understand which processes you are terminating before taking action
- You waive any right to hold Licensor liable for any damages, losses, or issues arising from your use of the Software
3. Disclaimer of Warranties
THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED.
Licensor expressly disclaims all warranties, including but not limited to:
- Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
- Any warranties regarding the accuracy, reliability, or completeness of the Software
- Any warranties that the Software will meet your requirements or expectations
- Any warranties that the Software will operate uninterrupted or error-free
- Any warranties of compatibility with your specific system configuration or software environment
4. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
In no event shall Licensor, its affiliates, officers, directors, employees, agents, or licensors be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages, including without limitation:
- Loss of data, files, or documents (whether saved or unsaved)
- Data corruption or costs associated with data recovery
- System crashes, instability, or downtime
- Business interruption or operational disruption
- Loss of profits, revenue, savings, or business opportunities
- Loss of goodwill, reputation, or customer relationships
- Cost of procurement of substitute goods or services
- Any other pecuniary or non-pecuniary losses
This limitation applies regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise) and even if Licensor has been advised of the possibility of such damages.
5. Indemnification
You agree to indemnify, defend, and hold harmless Licensor and its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to your use of the Software or violation of this Agreement.
6. Termination
This license is effective until terminated. Your rights under this license will terminate automatically without notice if you fail to comply with any of its terms. Upon termination, you must cease all use of the Software and destroy all copies in your possession.
7. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the Netherlands. Any disputes shall be subject to the exclusive jurisdiction of the courts of the Netherlands.
8. Entire Agreement
This Agreement constitutes the entire agreement between you and Licensor regarding the Software and supersedes all prior agreements, understandings, and representations.

BY INSTALLING, COPYING, OR OTHERWISE USING THIS SOFTWARE, YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT, UNDERSTAND IT, AND AGREE TO BE BOUND BY ITS TERMS AND CONDITIONS.
IF YOU DO NOT AGREE TO THESE TERMS, DO NOT INSTALL, COPY, OR USE THIS SOFTWARE. IMMEDIATELY DELETE ANY COPIES IN YOUR POSSESSION.
