1. FREE SOFTWARE - NO COMMERCIAL RELATIONSHIP

This software is provided completely free of charge as a personal hobby project. By accepting this agreement:

• You acknowledge this is NOT a commercial product
• You acknowledge the developer is an individual hobbyist, not a company
• You acknowledge there is NO commercial relationship between you and the developer
• You acknowledge you have NO right to support, updates, or maintenance
• You acknowledge you received this software for zero euros

2. NATURE OF THE SOFTWARE

KillPorts is a system utility that:

• Scans for processes listening on network ports
• Terminates (kills) those processes upon user request
• Uses system commands including lsof and kill

WARNING: This software operates at the system level and can terminate any process the current user has permission to kill, which may cause data loss, system instability, or service interruption.

3. COMPLETE ASSUMPTION OF RISK

BY INSTALLING AND USING THIS SOFTWARE, YOU EXPRESSLY AND UNCONDITIONALLY ASSUME ALL RISKS, INCLUDING BUT NOT LIMITED TO:

• Complete or partial data loss
• System crashes, freezes, or instability
• Corruption of files or applications
• Interruption of services, servers, or applications
• Loss of unsaved work
• Hardware damage resulting from improper shutdowns
• Financial losses or business interruption
• Any and all other consequences, foreseeable or not

4. COMPLETE DISCLAIMER OF WARRANTIES

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND WHATSOEVER, EXPRESS, IMPLIED, OR STATUTORY.

The developer expressly disclaims all warranties including but not limited to:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy, reliability, or completeness
• Error-free or uninterrupted operation
• Compatibility with your system
• Security or safety

5. ABSOLUTE LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• The developer's total cumulative liability shall not exceed zero euros
• The developer shall NOT be liable for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages
• The developer shall NOT be liable for loss of data, profits, revenue, business, goodwill, or anticipated savings
• The developer shall NOT be liable for any damages whatsoever, even if advised of the possibility of such damages

6. INDEMNIFICATION AND HOLD HARMLESS

You agree to fully indemnify, defend, and hold harmless the developer from and against any and all claims, damages, losses, costs, expenses (including reasonable attorney's fees), and liabilities arising from:

• Your use or misuse of the software
• Your violation of this agreement
• Your violation of any applicable law
• Any claim by a third party related to your use of the software

7. USER RESPONSIBILITIES

By using this software, you represent and warrant that:

• You are at least 18 years of age or have parental/guardian consent
• You will only use this on systems you own or have explicit authorization to administer
• You will maintain appropriate backups before using this tool
• You will save all work before terminating processes
• You will not use this software for malicious, illegal, or unauthorized purposes
• You will comply with all applicable laws and regulations

8. NO SUPPORT OR MAINTENANCE

The developer has NO obligation to provide:

• Technical support of any kind
• Bug fixes or updates
• Documentation or training
• Responses to inquiries
• Any other assistance whatsoever

9. DISPUTE RESOLUTION

Before initiating any legal action, you agree to first attempt to resolve any dispute through good-faith negotiation for a minimum period of 60 days.

Any dispute that cannot be resolved through negotiation shall be submitted to binding arbitration in accordance with the rules of the Netherlands Arbitration Institute (NAI), with the place of arbitration being Amsterdam, Netherlands.

You waive any right to participate in class action lawsuits or class-wide arbitration against the developer.

10. GOVERNING LAW AND JURISDICTION

This agreement shall be governed by and construed in accordance with the laws of the Netherlands, without regard to conflicts of law principles. Any legal proceedings shall take place exclusively in the courts of Amsterdam, Netherlands.

11. SEVERABILITY

If any provision of this agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.

12. ENTIRE AGREEMENT

This agreement constitutes the entire agreement between you and the developer regarding the software and supersedes all prior or contemporaneous agreements.
